1. Introduction

These Terms also apply to any construction-related services or goods provided through the website.

2. Eligibility

2.1. By using this website, you confirm that you are at least 18 years old or have the legal capacity to enter into agreements in your jurisdiction.

2.2. If you are acting on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these Terms.

 3. Use of the Website

3.1. You agree to use the website for lawful purposes and refrain from any activities that may harm the website, its users, or our reputation.

3.2. You must not:

   - Introduce viruses, trojans, or other malicious software.

   - Attempt to gain unauthorised access to the website or its systems.

   - Use automated tools (e.g., bots, scrapers) to access or interact with the website.

3.3. We reserve the right to suspend or terminate your access to the website if you breach these Terms.

4. Construction Services and Goods

4.1. Quotations and Pricing

   - Quotations provided through the website or otherwise are valid for 30 days unless stated otherwise.

   - Prices displayed on the website (if applicable) may not include VAT or delivery costs unless specified.

   - We reserve the right to correct errors or omissions in pricing and update prices without prior notice.

4.2. Booking Payment / Deposit

4.2.1 Once a quotation has been accepted, we will normally require a booking payment before allocating and reserving a start date or project period within our work schedule.

4.2.2 Our standard booking payment is typically 30% of the total agreed cost of the works. For certain projects, the booking payment may be higher and may be up to 50% of the total agreed cost of the works.

A higher booking payment may be required where, for example, the project involves substantial material purchases, bespoke or non-returnable goods, significant supplier commitments, subcontractor costs, extended diary reservation, or other project-specific expenditure.

4.2.3 The exact booking payment required for each project will be clearly stated in the quotation, contract or payment schedule provided to the client before the booking is confirmed.

4.2.4 The booking payment forms part of the total contract price and is not an additional charge.

4.2.5 In accepting the quotation and paying the booking payment, the client confirms that they wish us to reserve labour, project capacity and diary time for the agreed or provisionally agreed project period.

4.2.6 No project date or project period is secured until the required booking payment has been received and we have confirmed the booking in writing.

4.2.7 The booking payment may also be used towards costs reasonably incurred in preparing for the project, including materials, bespoke items, supplier orders, subcontractor commitments, project preparation and administration.

4.2.8 Where a project is cancelled or postponed by the client, any sums already paid will be dealt with in accordance with the cancellation and postponement provisions set out in these Terms.

4.3 Cancellation by the Client

4.3.1 Statutory cancellation rights

Where the client is a consumer and the contract is entered into at a distance or away from our business premises, the client may have a statutory right to cancel the contract within 14 days from the date the contract is entered into, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Legislation.gov.uk

Nothing in these Terms affects the client’s statutory rights.

Where the client expressly requests that we begin providing services during the statutory cancellation period, and we agree to do so, the client will be responsible for paying a proportionate amount for any services properly supplied up to the point at which we receive notice of cancellation, where permitted by law. Legislation.gov.uk

4.3.2 Cancellation after any applicable statutory cancellation period

Once any applicable statutory cancellation period has expired, the client may cancel the project at any time by giving us written notice.

Where the client cancels a confirmed project, they will be responsible for our reasonable losses and costs directly resulting from the cancellation.

These may include, where applicable:

  • work, surveys, design, planning or preparation already undertaken;

  • materials already purchased or ordered;

  • bespoke, made-to-measure, specially manufactured or non-returnable goods;

  • supplier cancellation, delivery or restocking charges;

  • subcontractor costs or other third-party commitments;

  • reasonable administration and project preparation costs;

  • labour and working time specifically reserved for the project which we are unable reasonably to replace with alternative work; and

  • reasonable loss of profit directly resulting from the cancellation.

We will take reasonable steps to minimise our losses, including seeking replacement work where reasonably practicable.

4.3.3 Treatment of the booking payment

The booking payment, which is typically 30% of the total agreed cost of the works and may be up to 50% for certain projects, will be credited against any amounts properly due following cancellation.

Payment of a booking payment does not mean that the whole amount will automatically be retained if the project is cancelled.

Where our reasonable losses arising from the cancellation are less than the amount already paid, the balance will be refunded to the client.

Where our reasonable losses exceed the amount already paid, the client will remain liable for the outstanding balance of those reasonable losses.

We will not retain or seek payment of more than the reasonable loss caused by the client's cancellation.

This reflects the current CMA/GOV.UK position that a business may generally recover actual losses resulting from cancellation, but cancellation charges should not be disproportionate or amount to a penalty. GOV.UK

4.3.4 Cancellation close to the agreed start date

The client acknowledges that cancelling a project close to its agreed start date may cause greater financial loss because labour, subcontractors and diary capacity may have been reserved specifically for their project and replacement work may not reasonably be available at short notice.

Where cancellation results in reserved working time remaining unfilled despite reasonable efforts to obtain alternative work, that loss may be included in the amount due under clause 4.3.2.

4.3.5 Calculation of cancellation costs

Where cancellation charges apply, we will provide the client with a reasonable explanation or breakdown of how the amount has been calculated.

The cancellation charge will take account of:

  • costs already incurred;

  • commitments that cannot reasonably be cancelled or recovered;

  • losses arising from reserved labour and diary capacity;

  • any replacement work we have been able reasonably to obtain; and

  • any other savings resulting from the project not proceeding.

4.3.6 Method of cancellation

Cancellation should be given in writing by email to:

info@lpcarpentryconstruction.co.uk

Cancellation will take effect when we receive the client's written notice, subject to any statutory rights that apply.

4.4. Scope of Work

   - The agreed scope of work will be detailed in a formal contract provided separately. Changes to the scope must be agreed in writing and may incur additional costs.
